It is important that both the <strong>landlord<\/strong> and the <strong>tenant<\/strong> understand their respective legal obligations regarding the <strong>conservation and maintenance<\/strong> of the property, in order to ensure a harmonious relationship and avoid conflicts. This obligation is set out in the <strong>Civil Code<\/strong>, the <strong>Horizontal Property Law<\/strong> and the <strong>Urban Leases Law<\/strong> (Law 29\/1994, of 24 November), among other regulations.<\/p>\n<p>According to Article 21 of the Urban Lease Law, the landlord must cover the cost of all repairs necessary to maintain the dwelling in a suitable condition for habitation, without the right to increase the rent for this reason. However, this obligation does not apply when the damage is caused by a <strong>misuse<\/strong> or the tenant's failure to maintain the property.<\/p>\n<h3>What happens if the property needs urgent repairs?<\/h3>\n<p class=\"translation-block\">If a conservation problem is detected that goes beyond <strong>minor repairs<\/strong> associated with the normal use of the property, the owner is responsible for carrying out the repairs as soon as possible. According to Article 21, the tenant must notify the owner of the need for the repair and allow access to the property so that the problem can be verified and the repair carried out.<\/p>\n<p>If the situation is urgent and causes serious discomfort or imminent damage, the tenant may proceed to carry out the repair and then request reimbursement of the expenses from the owner. This process applies only in emergency situations and must be communicated to the owner beforehand.<\/p>\n<h3>What happens if maintenance works prevent the full use of the property?<\/h3>\n<p class=\"translation-block\">When <strong>conservation works<\/strong> are so extensive that they hinder the normal use of the property, Article 21 of the Urban Leases Law establishes that the tenant is obliged to tolerate them, even if they are inconvenient or affect part of the property. However, if the duration of the works exceeds twenty days, the owner must reduce the rent in proportion to the part of the property that the tenant cannot use during that time.<\/p>\n<h3>Tenant\u2019s obligations regarding the maintenance of the property<\/h3>\n<p>The tenant also has obligations regarding the maintenance of the dwelling, especially with regard to the <strong>minor repairs<\/strong> resulting from normal wear and tear. These repairs are the tenant\u2019s responsibility and cannot be claimed from the landlord. This matter is governed by Article 21 of the Urban Lease Law, which specifies that maintenance resulting from normal use is the tenant\u2019s responsibility.<\/p>\n<h2>Improvement works<\/h2>\n<p class=\"translation-block\">In addition to conservation repairs, the owner may decide to carry out <strong>improvement works<\/strong> on the property. These works are not intended for repair, but rather to improve the property and represent an investment to increase its value. Improvement works are regulated in Article 22 of the Urban Leases Law, which establishes that the owner must notify the tenant of the carrying out of these works at least three months in advance.<\/p>\n<p>After receiving the notice, the tenant has one month to decide whether to <strong>withdraw from the contract<\/strong>. If the lease continues, the tenant will be entitled to a rent reduction proportional to the impact of the construction work and may also demand compensation for expenses incurred due to the inconvenience caused by the work.<\/p>\n<h3>Impact of improvement works on the rent<\/h3>\n<p>Article 22 provides that if the tenant decides not to terminate the lease, he or she may choose to request a <strong>income reduction<\/strong> in proportion to the inconvenience caused and the length of time during which your use of the dwelling is affected. This reduction may be negotiated with the landlord, who must offer fair compensation for the inconvenience caused by the construction work.<\/p>\n<h2>What happens if maintenance works make the property uninhabitable?<\/h2>\n<p class=\"translation-block\">If the conservation works are of such magnitude that they make the property <strong>uninhabitable<\/strong>, the tenant has the right to choose between the temporary suspension of the contract or its definitive termination, without any penalty. Suspension of the contract implies the interruption of its term, as well as the suspension of the obligation to pay rent while the works last. This provision is set out in Article 28 of the Urban Leases Law.<\/p>\n<h2>Tenant\u2019s obligations regarding the contract<\/h2>\n<p>Article 21 of the Urban Leases Law establishes that all minor repairs and the maintenance of elements of everyday use in the property are the responsibility of the tenant.
