Owners in condominiums are subject to rules governing coexistence and respect. However, they are also entitled to assert their rights against neighbors and third parties.<\/strong><\/p>\n<p>Under Spain's Condominium Act, the law regulates the rights and responsibilities of owners living under this regime.<\/p>\n<h2><strong>Owners' Rights in a Condominium<\/strong><\/h2>\n<p>Owners\u2019 rights under condominium laws are less widely known than their obligations as co-owners. For this reason, the law governing this matter aims to clarify every provision that benefits individual owners. These rights are:<\/p>\n<h3><strong>The use and enjoyment of all common areas<\/strong><\/h3>\n<figure id=\"attachment_33860\" aria-describedby=\"caption-attachment-33860\" style=\"width: 2000px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-33860 size-full\" src=\"https:\/\/www.cbleon-abogados.com\/wp-content\/uploads\/2023\/02\/Derechos-de-los-propietarios-en-una-propiedad-horizontal.jpg\" alt=\"Owners&#039; Rights in a Condominium\" width=\"2000\" height=\"1333\" \/><figcaption id=\"caption-attachment-33860\" class=\"wp-caption-text\">Owners' Rights in a Condominium<\/figcaption><\/figure>\n<p>This is the most significant right granted to each owner. As such, owners may use, occupy, and enjoy all areas designated as common areas. This right may be exercised provided that it does not violate the law, the community agreements, or the rights of other residents.<\/p>\n<p>This principle serves as a reminder of the legal maxim that states: \u201cMy rights end where my neighbor\u2019s begin.\u201d Property owners must be legally aware of the rights they possess and those held by others.<\/p>\n<h3><strong>To run for and be elected to representative offices in the community<\/strong><\/h3>\n<p>A co-owner may run for office or nominate another person to hold any position within the assembly. This is an extension of their political rights that gives them the opportunity to run for office or to choose a neighbor to run in their place.<\/p>\n<p>The law encourages community participation so that community leaders can be removed through a vote once their term has ended. The renewal of the individuals who guide the future of the <a href=\"http:\/\/www.afincalitas.com\/comunidades-vecinos-propietarios\/derechos-y-obligaciones-comunidad-de-propietarios\/\" target=\"_blank\" rel=\"noopener\">condominium<\/a> It is both a priority and a legal requirement.<\/p>\n<h3><strong>Attend and vote at board meetings<\/strong><\/h3>\n<p>Owners are duly authorized to attend all meetings called by the board of directors, whether ordinary or special. At such meetings, owners shall present their requests to the community and cast their votes when their proposals are considered.<\/p>\n<p>This right is traditionally known as the right to speak and vote. This authority is closely linked to the power to call a meeting attended by more than 25% of the members. At these meetings, matters related to co-ownership may be addressed, depending on the case and its urgency.<\/p>\n<p>Let\u2019s remember that the primary purpose of these rules is to foster a friendly atmosphere among neighbors and thereby prevent problems and conflicts.<\/p>\n<h3><strong>Refusing to contribute to an unnecessary project<\/strong><\/h3>\n<p>Owners may refuse to pay for expenses incurred as a result of specific construction work that has not been approved by the owners\u2019 meeting. Any work that involves physical alterations to a property subject to the LPH regulations must be approved by the community.<\/p>\n<p>However, if the work proceeds despite the provisions of the regulations, any of the co-owners may refuse to pay their share of the costs. This justification allows them to refuse to validate a decision that was never submitted for consideration by the assembly or, failing that, approved.<\/p>\n<h3><strong>Physical changes to your apartment<\/strong><\/h3>\n<p>All owners in a condominium have the right to make changes to their apartment or commercial space without compromising the building\u2019s external physical structure.
