A week later, the defendant admitted his uncle to the Valdeluz Residential Center, and that same day a notice was filed with the M\u00f3stoles Court announcing the commitment of a person deemed legally incompetent.<\/span><\/p>\n

Before being admitted as just another patient, the uncle authorized his nephew to use one of his accounts; this allowed the nephew to access his other funds and conduct transactions as he saw fit.<\/span><\/p>\n

The defendant moved all the money at his own discretion <\/strong><\/span><\/h3>\n

The prosecution explains that the defendant used the account for which she had authorization to make transfers and withdrawals both while her uncle was alive and after his death.<\/span><\/p>\n

This money was intended for his own account, as well as those of his children, his wife, and a nephew, but after his conviction, it had to be returned to the National Brotherhood of the Blue Division.<\/span><\/p>\n

It was also shown that during the first few months of 2010, the nephew redeemed an investment fund and made four withdrawals, leaving him with a total of 293,296 euros.<\/span><\/p>\n

Finally, the prosecution points to the sale of a property in Murcia; the price was \u20ac100,000, but only \u20ac24,000 was paid, and the remainder was issued as a promissory note due on May 10, 2010.<\/span><\/p>\n

Apparently, the defendant never intended to pay off the promissory note and failed to fulfill his part of the agreement once the agreed-upon date arrived.<\/span><\/p>\n

His crime will not go unnoticed<\/strong><\/span><\/h3>\n

The Prosecutor's Office classified the aforementioned actions as a crime and requested a 6\u00bd-year prison sentence for the accused man. His trial will take place next Wednesday at the Provincial Court of Madrid.<\/span><\/p>\n

The representative of the Public Prosecutor's Office states that his crime was the misappropriation of his uncle's property, in addition to the fraud committed in connection with the purchase and sale of the property.<\/span><\/p>\n

Similarly, he must pay a fine for 12 months at a daily rate of 3,600 euros and must pay 152,850 euros in compensation to the National Brotherhood of the Blue Division.<\/span><\/p>\n

This amount will be received by the institution as compensation for the property and the debt associated with it, which previously amounted to 64,000 euros but is now higher due to the damages caused.<\/span><\/p>\n
